A former Ciena Healthcare employee has prevailed in a lawsuit she filed against Ciena Healthcare in Southfield, Mich., accusing the nursing and rehabilitation provider of firing her for cooperating in a state investigation over two patient deaths, according to a McKnight's report.
Michigan Department of Community Health officials were investigating two deaths that occurred at Omni Continuing Care, which is operated by Ciena. According to the news report, state regulators issued a citation to OCC for failing to supervise a hypoglycemic resident who was not eating and later died. Regulators also cited OCC for failing to monitor a resident who tried to pull out his tracheostomy tube. That resident later died, according to the report. OCC was dinged with several other citations related to negligence.
The former Ciena employee, a nursing home manager, filed a lawsuit against the parent company, alleging she had been fired after she cooperated in the investigation. The circuit court deliberated for 90 minutes and awarded her $705,000.
