Here are seven things physicians should know about noncompetes in 2023 so far:
1. In January, the Federal Trade Commission proposed a rule that would keep employees free from noncompete contracts. The rule would apply to full-time employees and independent contractors, both paid and unpaid.
2. In February, President Joe Biden delivered the State of the Union address. Regarding noncompete agreements he said, "We're banning those agreements so companies have to compete for workers and pay them what they're worth."
3. The American Hospital Association is asking the FTC to withdraw its proposal to ban noncompete agreements.
4. About 87 percent of physicians support the Federal Trade Commission's proposed rule that would ban employers from imposing noncompete contracts, according to a March Doximity poll of 4,853 practicing physicians.
5. Indiana's House of Representatives voted in favor of a noncompete ban bill for only primary care physicians, excluding specialty physicians.
6. The Connecticut Legislature passed a bill amending the state's physician noncompete statute.
7. The New York State Legislature passed a bill aiming to stop employers from entering into noncompete agreements with their employees.
